in politics, where emotion will pull the logic train. the emotion of what happened in newtown, connecticut, the emotion contained in a week of funerals, we're at the front of a church or synagogue or a mosque, you're going to be very small -- there are going to be very small caskets. t.j., if we still have the picture of jack pinto buried yesterday in newtown, connecticut, buried in his little league uniform, that right there is what is going to change the dialogue for this. people carry around for years pictures of their children in little league uniforms, hockey uniforms, first and second grade school picture. that's the picture, the emotion that will pull this thing. >> if it doesn't, there's a serious problem. i understand the president does -- has a lot to do, when it comes to making sure that our economy doesn't fall off the cliff. there are tens of millions of working americans that know that the fiscal cliff situation needs to be addressed. isn't human nature funny, though, how we need to get moving on this? >> those critical issues you just mentioned, they seem so insignificant. >

. you know, the court in a case called griswald versus connecticut know there is a right to privacy in the u.s. constitution. but it has never been explicitly applied to text messaging and -- this case and if a law like this is passed, i think you will see the courts looking at whether text messages are legitimately private. i will say one thing, it is clear, by the way, that the cops would have to get a certain much warrant to get your text messages. but here, this is a law that will force companies to save the text messages for an extensive period of time. >> does it make them liable? >> well, maybe american citizens don't want the stuff stored for an extensive period of time. let's say you were applying for a job and the employer said you know something, i want to see what kind of a person you are, give me an authorization for all your text message it is last five years. and you say -- oh, what? how many american citizens would want that to happen? this is a major privacy issue. it has never been addressed directly by congress. i think it is going to be enormously controversial.

of snow in some areas, especially back into ohio, pennsylvania and new york state. granby, connecticut, picked up six inches before it changed over to rain. we saw winds gusting up near hurricane-force strength in brick, new jersey. 74-mile-per-hour wind gusts. most of the eastern seaboard did see gusts in excess of 50 miles per hour. this storm is still lingering across northern new england where winter storm warnings and advisories are still in effect. heaviest of the snow, though, is where they want it, up across the ski resorts through northern new york, up into vermont, new hampshire and eventually maine as well. it's the extreme northern tier of the country that could end up with more than two feet of snow. elsewhere in new england, we'll get another foot of snow in central and northern new england. rain will wind down later today and then tomorrow as we head into friday, it looks like things will finally improve. a little chilly, but the sunshine is back. temperatures tomorrow should top out in the mid to upper 30s. so improvements, they're slow to get here, but they'll still ge
